ExoClick respects the intellectual property rights of others and we expect that all of our clients do the same. Please note that laws in different countries may vary. For more information on copyright law, you can visit the website of the World Intellectual Property Organisation (WIPO). Regardless thereof, ExoClick qualifies as an “Intermediary Service Provider” within the meaning of the U.S. Digital Millennium Copyright Act (“DMCA”) as well as in other regulations such as the Spanish Law of Information Society Services (“LSSI”), and the EU Digital Services Act (“DSA”). Consequently, we have adopted the following Policy and the Copyright Report Form relating to claims of copyright infringement, involving our customers, subscribers, or users. Upon receipt of a notice alleging copyright infringement, ExoClick will take whatever action it deems appropriate within its sole discretion, including removal of the allegedly infringing materials that are accessible directly within its platform and termination of access for repeat infringers of copyright-protected content. DMCA relevant Information: While ExoClick is not located in the United States, we respect the intellectual property rights of copyright owners and, on a voluntary basis, adhere to the notice-and-takedown framework of the DMCA. ExoClick is a “service provider” as defined in 17 U.S.C. § 512(k)(1) and, as such, may rely on the DMCA’s safe-harbor protections against certain copyright infringement claims. For clarity, ExoClick’s role is limited to connecting advertisers with publishers. We do not host, manage, or control the content made available on third-party websites. Therefore, our DMCA procedures apply exclusively to advertising material that is directly accessible through our platform. In accordance with the DMCA, ExoClick has appointed a DMCA Designated Agent, in this case, the ExoClick Compliance Team, who should be reached via the Copyright Report Form below. Publishers, as the parties hosting the content, remain responsible for all content displayed on their websites and are required to respond to valid DMCA takedown notices when the allegedly infringing content is hosted on their sites. Please note that ExoClick requires all of its publishers to maintain a clear DMCA/Copyright policy on their website with a working notice and action mechanism or contact email address where you can submit DMCA/Copyright challenges to them legally negating the need for ExoClick to be involved as a mediator. How to Report a Copyright Infringement? If you believe that your intellectual property rights have been violated by a third party who has uploaded materials which are directly accessible within our platform, please provide the relevant information requested in our Copyright Report Form below, including but not limited to a description of the copyrighted work or other intellectual property that has been infringed. What is the procedure followed once a valid DMCA or DSA notice is received? ExoClick Compliance Team follows the procedure below upon receipt of a valid DMCA or DSA notice concerning advertising material that is directly accessible through our platform:- Upon receipt of a valid notice, we may disable access to, or remove, the allegedly infringing material available on our platform. We may request additional information before removing any allegedly infringing material.
- We will notify the affected advertiser and give them an opportunity to submit a counter-notification if they believe the material was removed in error.
