We take Copyright Infringement seriously

ExoClick respects the intellectual property rights of others and we expect that all of our clients do the same. Please note that laws in different countries may vary. For more information on copyright law, you can visit the website of the World Intellectual Property Organisation (WIPO). Regardless thereof, ExoClick qualifies as an "Intermediary Service Provider" within the meaning of the U.S. Digital Millennium Copyright Act ("DMCA") as well as in other regulations such as Spanish Law of Information Society Services ("LSSI"), and the EU Digital Services Act ("DSA"). Consequently, we have adopted the following Policy and the Copyright Report Form related to claims of copyright infringement, ExoClick will take whatever action it deems appropriate within its sole discretion, including removal of the allegedly infringing materials and termination of access for repeat infringers or copyright-protected content.

DMCA relevant information:

In accordance with the DMCA, ExoClick has appointed a DMCA Designated Agent, in this case, the ExoClick Compliance Team, who should be reached via the Copyright Report Form below. It should be noted that ExoClick asks all of its publishers to have a clear DMCA/Copyright policy on their website with a working contact form or contact email address where you can submit DMCA/Copyright challenges to them legally negating the need for ExoClick to be involved as a mediator.

How to Report a Copyright Infringement

If you believe that your intellectual property rights have been violated by a third party who has uploaded materials as marketing material, or features on a publisher's website, please provide the relevant information requested in our Copyright Form below, including but not limited to a description of the copyrighted work or other intellectual property that has been infringed.   In circumstances where ExoClick has the possibility to remove marketing material, ExoClick may request additional information before removing any allegedly infringing material. In the event ExoClick removes the allegedly infringing materials, ExoClick will immediately notify the person responsible for posting such marketing materials that ExoClick removed or disabled access tot he marketing materials. ExoClick may also provide the responsible person with your email address so that the person may respond to your allegations.   However, where ExoClick does not host the allegedly infringing material it will not be able either to assess its legality or to remove it. Thus, as a mediator, ExoClick will forward the complaint to the publisher or website owner who has the ability and responsibility to address the request effectively.   To report other types of illegal material, please use this form.
